Dr. Kays is a nationally recognized Landscape Architect, Environmental and Soil Scientist that is specialized in sustainable environmental design and in soil, groundwater, and hydrologic science; He has consulted on residential, commercial, institutional, and governmental development projects across the United States.  Dr. Kays has testified in numerous state and federal court cases involving environmental science, environmental damage analysis, landscape architecture, land development, soil science, sedimentation, groundwater, and hydrologic science.

Selected Sustainable Design Projects:

 

Creative Arts Building, Haywood Community College, Clyde, NC, 2010

The project consists of the design of environmentally sustainable and innovative building and landscape as consultant to Innovative Design, Inc.  The work involves: design of rainwater catchment, stormwater treatment & reuse system, soil amendments, subsurface drainage, and landscaping.  The stormwater treatment & reuse system consists of sand filtration, stormwater wetland pond, intermittent sand filtration, solar pumping system, four waterfalls then recirculating back through the wetland pond. Project will received 2011 LEED Platinum Award from U.S. Green Building Council.

 

Freshman Hall #4, Parking Deck and Green Roof Plaza, Emory University, Atlanta, GA, 2009

The project consists of the design of environmentally sustainable and innovative freshman complex for LEED certification as consultant to Ayers/Saint/Gross Architects.  The work involves: design of rainwater catchment, stormwater reuse system, and green roof soil and drainage system for construction on top of the parking deck for the freshman hall #4.  The work also involves responsibility for coordination of production and testing of green roof soil system.  Project will receive 2010 LEED Platinum Award from U.S. Green Building Council.

 

Sustainable Living Center, Maharishi University, Fairfield, IA, 2009

The projects involved the design of an “off-the-grid” university building and grounds including electric generation, rainwater catchment and treatment, wastewater treatment and reuse, and stormwater catchment and reuse systems.  The stormwater treatment and reuse, fountain, and stream flow is powered by automated tracking photovoltaic generation system.  The design work was conducted as consultant to Innovative Design, Inc.  Project will receive 2011 LEED Platinum Award from U.S. Green Building Council.

 

Guilford County Schools, Reedy Fork Elementary School, Greensboro, NC, 2008

The project consists of the design of environmentally sustainable and innovative campus for LEED certification as consultant to project architect.  The work involves: campus site planning, design of innovative wetland stormwater bioretention and pond treatment systems, design of sports fields, and adjacent ecological park, and special soil reclamation for natural plant species laboratory. The work also includes responsibility for geotechnical investigations, soil hydraulic investigations, wetland delineations, special soil fertility investigations, and water quality management planning.  Project received 2009 Energy Star Certification and meet LEED Gold Standards.

 

Guilford County Schools, Northern Guilford County Middle School, Greensboro, NC, 2007

The project consists of the design of environmentally sustainable and innovative campus for LEED certification as consultant to project architect.  The work involves: campus site planning, design of innovative wetland stormwater bioretention and pond treatment systems, design of innovative wastewater treatment and reuse drip irrigation system on sports fields, and special soils reclamation for natural plant species laboratory. The work also includes responsibility for environmental audit, geotechnical investigations, soil hydraulic investigations, groundwater investigations, wetland delineations, special soil fertility investigations, and water quality management planning for site within Greensboro’s water supply watershed. Project received 2008 Beyond Green High Performance Building Award from Sustainable Building Industry Council and 2008 Energy Star Certification and meet LEED Gold Standards.

 

NCDOT US-421 Mountain Region Visitors Center, Wilkesboro, NC, 2006

The project consists of design of environmentally sustainable and innovative wetland stormwater treatment systems for NCDOT.  The stormwater system includes stormwater wetland ponds, infiltration systems, mountain bog treatment systems, waterfalls in mountain landscape, and outdoor environmental education center.  Project received 2007 LEED Gold Award from U.S. Green Building Council.

 

Greenville Public Schools, Grove Elementary & Riverside High Schools, Greenville, SC, 2005

The projects involved fast-track redesign of stormwater systems to include a wetland treatment system and bring the both school’s sustainable site design up to LEED status.  Stormwater systems include marsh and terrestrial wetland habitats.  The work was part of overall sustainable redesign of these new schools as consultants to the project architect.  Each project received 2007 LEED Gold Award from U.S. Green Building Council.

 

NC Legislative Building, Roof Rainwater Catchment System, Raleigh, NC, 2005

The project involved the redesign of existing landscape irrigation system and design of roof rainwater catchment, storage and treatment system for NC General Assembly building.  The building was built in the 1960’s with a roof plaza and garden.  The redesign achieved reuse of stormwater, reduce use of potable water, and pollutant removal through on-site biological treatment in the landscape. 

 

Wake County Public School System, Heritage Middle School, Raleigh, NC, 2004

The project consists of design of innovative stormwater wetland treatment pond system and outdoor ecological laboratory for this energy efficient and environmentally sustainable school as consultants to project architects.  The stormwater system includes open water, marsh and terrestrial wetland habitats, islands, water quality and meteorological monitoring station, windmill power generation, and student observation access bridge.  Project received 2005 Nation’s Top Exemplary Sustainable Building Award from U.S. Sustainable Building Industry Council.

 

Selected Governmental Design Projects:

 

NCSU, Lake Raleigh Restoration, Raleigh, NC, 1999

The project involved working with the existing campus consulting design team by providing environmental studies, alternative lake designs, and permitting for the lake restoration after breach of dam by Hurricane Fran at the NC State University’s Centennial Campus; as consultant to project landscape architectural firm.

 

UNC, North Carolina Arboretum, Asheville, NC, 1997

The project involved the planning of roadways, parking, environmental protection systems, and garden projects for 450-acre facility for University of North Carolina, located within the Bent Creek Experiment Station, United States Forest Service; as consultant to architectural & landscape architectural firm.  The project included the ecological restoration of Bent Creek floodplain, innovative stormwater systems with turbidity controls adjacent to Mountain Trout Waters.  Project received 1998 Excellence Award for Design for NC Arboretum and 2000 Honor Award for Design for Fredrick Law Olmsted Entrance Causeway from North Carolina Chapter of American Society of Landscape Architects.

 

Great Lawn & Belvedere Lake Restoration, Central Park, New York, NY, 1996

The project involved the planning and design of largest urban park environmental and landscape restoration project in world; as consultant to Central Park Conservancy, Inc.  Project involved restoration of Great Lawn and Belvedere Lake that was constructed over turn of 20th century landfill.  Project work included geotechnical investigations, stabilization of landfill cap, design of 24-acre bioretention stormwater treatment system, hydrologic and drainage modeling over 72-years of metrological records, construction of landfill water management system, assessment of metals contamination, and dredging and disposal of lake contaminated sediments.  Belvedere Lake was rebuilt to include deep water habitats, shallow water marshes, Turtle Island, observation deck and birding screen.  The lake now serves as Outdoor Ecological Center for Borough of Manhattan Schools.  Project received Best of 1998 Site Design Award from F.W. Dodge New York Construction News, McGraw-Hill and 1998 Honor Award for Design from American Society of Landscape Architects.

 

Cedar Hill Restoration, Central Park, New York, NY, 1994

The project involved the planning and design of restoration of Cedar Hill, a portion of Central Park immediately south of Metropolitan Museum of Art and adjacent to 5th Avenue.  The plan involved preservation of mature evergreen forest, design of snow sledding hill, and redesign of surface and subsurface drainage facilities; and replacement of decayed 1865-cir. subsurface wooden tile drainage lines.  The project used a method of soil restoration incorporating high rates of composted humus to increase water holding capacity of hill side soils.

 

Selected Governmental Environmental Projects:

 

US Department of Justice, Washington, DC and US Army Corps of Engineers, Omaha District, Omaha, NE, 2008

The project consists of a forensic flooding and sedimentation study of approximately 32,000 acres in the Moreau River floodplain and study of allegations regarding US Army Corps of Engineers Oahe Reservoir project in northwest South Dakota.  The work was conducted pursuant to suit in U.S. Federal Court of Claims alleging 1997 flood and sediment damages to agricultural bottomlands in the Cheyenne River Sioux Indian Reservation, Dewey County, SD.  Sediment layers along a 28-mile section of the Moreau River were correlated with flood events from 1968 through 2003.  The age of older sediment layers was determined by AMS 14C radiocarbon dating analysis.

   

US Department of Justice, Washington, DC and US Army Corps of Engineers, Rock Island District, Rock Island, IL,  for Drainage Districts in IL & MO, 2004

The project consisted of a forensic soil and surficial groundwater study of approximately 2,900 acres, DRAINMOD computer simulation modeling, and impact evaluation of allegations regarding US Army Corps of Engineers Mississippi River Nine Foot Navigational Channel at Lock & Dam 18 and 22, completed in 1937.  The work was conducted pursuant to suit in U.S. Federal Court of Claims.  The project involved allegations of $440 million in flooding and drainage damages to agricultural lands behind the levees at Henderson County Drainage District #3, IL and Marion County Drainage District, MO.  The water table computer simulation for 1950 through 2002 was prepared to determine the cause and effect of the high water tables in the drainage districts and in determining how the problems could be resolved through the use of modern agricultural water management controls.

 

US Department of Justice and US Fish & Wildlife Service, Washington, DC, 2002

The project consisted of a forensic soil and groundwater assessment study, DRAINMOD computer simulation modeling, and impact evaluation of influence of Pocosin Lakes National Wildlife Refuge water management plans and its affect on adjacent farm properties in Tyrrell County, NC.  The computer simulation model was used to predict crop yields and determine the factor affecting the yields.  The work was conduct for the defense of suit in U.S Federal Court of Claims for damages to adjacent farmlands.

 

New York City, Nelson B. Rockefeller Hudson River Park, New York, NY, 2001

The project consisted of forensic environmental and soil investigations of failure of soils and subsurface drainage system for recently constructed urban park. I served as investigator for project owners the Battery Park City Authority which filed claims in NY Supreme Court, Borough of Manhattan against architects, landscape architects, and construction managers.

 

Duke University, Duke Forest Preservation, Durham, NC, 1997

The project involved conducting environmental studies and assisting university attorneys at preventing condemnation of the internationally recognized research forest and proposed conversion to a sanitary landfill by Orange County; as consultant to Duke University School of the Environment.  We recommended and assisted in creation of federal easements with National Aeronautic and Space Administration and U.S. Department of Energy that successfully blocked the condemnation of the research forest.

 

NC National Guard, Military Base, Butner, NC, 1996

The project involved preparation of NEPA Environmental Assessment and planning for new mechanized ground-training facility, including creation of GIS system for 4,800-acre base and base-wide master plan, environmental studies, wetland assessments, endangered & threatened species surveys, impact assessments, and mitigation planning.

 

US General Services Admin., Atlanta, GA, Orlando, Tallahassee & Tampa, FL, 1995-1996

The project involved preparation of NEPA Environmental Assessments and environmental studies for new regional IRS Center in Atlanta, Georgia, and Federal Courthouse Expansions in Orlando, Tallahassee, and Tampa, Florida.

Bayou Cocodrie National Wildlife Refuge Management Plan, Concordia Parish, LA, 1994

The project involved the preparation of GIS-based ecological management plan for the wildlife refuge and facilitation of public involvement and public hearing for the proposed plan for U.S. Fish & Wildlife Service.

 

NC Department of Transportation, Raleigh, NC, 1992

The project involved preparation of portion of SEPA Environmental Assessment of proposed alignments for NC-24 divided highway between I-95 and I-40.

 

NC Department of Transportation, Raleigh, NC, 1989

The work consisted of numerous projects across the Piedmont Region and preparation of environmental assessments and remediation cost analysis for remediation of leaking underground storage tanks and landfills encountered in roadway widening projects.

The project involved the planning for the US-321 Lenoir Bypass Divided Highway in mountain region and preparation of SEPA Environmental Assessment.

 

United States of America v. Various Private Property Owners, Durham, NC, 1980 - 1985

The projects involved seven cases before United States Federal Court, Middle District, North Carolina; on behalf of United States regarding expert testimony on land development potential, soils, and environmental factors; regarding land condemnation cases for U.S. Army Corps of Engineers Falls of Neuse Reservoir Project.

Town of Garner WWTP Assessment, Garner, NC, 1997

The project involved preparation of SEPA Environmental Assessment for proposed 8-MGD wastewater treatment plant, land disposal of treated waters, and site testing of high-pressure spray volatilization system.

 

Town of Garner WWTP, Garner, NC, 1994

The project involved conducting special study to determine the hydraulic capacity and certification of 300-acre land application reuse system; the testing involved use of whole field infiltration tests, infiltration rate mapping, and capacity analysis with and without extensive renovations to irrigation equipment.

 

County of Hyde WWTP, Swansquarter, NC, 1992

The project consisted of detailed site analysis, soil hydraulic and chemical loading analysis for the design of spray irrigation of treated wastewater.  The study included DRAINMOD modeling of infiltration rates, drainage parameters, water table depth, and daily groundwater table plots using for 35-years of climatic records.

Cutter Creek Plantation, Snow Hill, NC, 2007

The project involved conducting a biological stream evaluation and groundwater contour study of property to determine locations of groundwater flows into intermittent stream channels in order to accurately establish beginning point of regulatory buffers along stream channels for construction of two new lakes.

 

Mack Brown Industries v. Wright Brothers Construction Company, Boone, NC, 2006

The civil case was before District Court in Watauga County, NC; I was responsible for soil science study and expert testimony regarding construction of construction of rock debris landfills associated with construction of new divided Highway US-421 in mountain region.

 

Infiltrator Systems, Inc., Old Saybrook, CT, 2005

The project involved development of new strategy for state environmental equipment approvals from ten states and initial implementation of strategy in North Carolina by rule making petition before N.C. State Health Services Commission.


Colony Pines Development, Newport News, VA, 2004

The project involved the wetland delineation of a hydrologically complex Grafton ponds landscape of a 60-acre property using Corps Delineation Manual and use of DRAINMOD computer simulation of groundwater from 1930 through 2002.  The investigation included time

of year and frequency of connection by surface and groundwater flows connecting to Water of the United States versus connection to isolated waters under State jurisdiction.  I prepared an expert report for administrative appeal of jurisdictional decision by U.S. Army Corps of Engineers, Norfolk District.

 

Department of Environmental Quality, Commonwealth of Virginia v. Sheaffer International, Ltd., Naperville, IL, 2003

The project consisted of an investigative study of soil, groundwater, and alleged compliance violations and civil penalties for construction and operation of large municipal spray irrigation wastewater facility with participating farmers in Shenandoah Valley in Northwestern Virginia on behalf of defendant.  I was responsible for testimony before Commonwealth Administrative Hearing; the defendant obtained full administrative relief.

 

The Park at Stony Point, Richmond, VA, 2002

The project consisted of conducting a groundwater flow network analysis for commercial development to determine compliance with Chesapeake Bay Resource Protection Act; analysis was used to determine groundwater low flow rates into ephemeral and intermittent stream channels for establishment of regulatory buffers along the stream channels.

 

JLM Terminals, Inc. v. Southern Metals Recycling, Inc. and Metals USA Shapes and Plates Southeast, Inc., Wilmington, NC, 2002 

The case was brought in Superior Court, New Hanover County, North Carolina; I served as expert witness on behalf of plaintiff’s coastal petroleum terminal re: allegations of damages from contamination of chemicals and hazardous materials discharged and flowed onto plaintiffs property, deposition from air due to explosion and fire, discharge to groundwater, and subsurface migration through the soils to Cape Fear River.  I prepared expert reports, proof of causation, breach of duty, negligent acts, coordinated other experts, prepared expert witness statements, and deposition testimony;  case settled.

 

The Board of Supervisors of Fairfax County, Virginia v. Governors Run, L.P. and Airston Group III, Inc., Fairfax, VA, 2001

The case was brought in District Court, Fairfax County, Virginia; I served as expert witness on behalf of defendant re: allegations of damages from off-site sedimentation, off-site stream channel erosion, construction of inadequate outfall, and submittal of inadequate plans, after construction of project.  I prepared expert report, coordinated other experts, assisted in mediation, assisted in preparation of experts’ statements, and assisted in affidavits for spoliation motion and evidentiary challenges. 

 

Prestonwood Country Club, Cary, NC, 2001

The project involved a study of  alternative roadway design analysis for Davis Drive widening to reduce the potential damages to the Prestonwood golf course; alternative cost of cures were determined for reconstruction of portion of the golf course; the alternatives and appraised damages were used to negotiate preferred roadway designs and thereby elimination of potential condemnation of golf course.

 

TRIAD International Airport Authority v. Charles Sims, Greensboro, NC; with comparable sites in CA, ID, IN, & TX, 1999

The case was brought before Superior Court, Guilford County, North Carolina; I served as expert witness on behalf of defendants re: valuation of property that was condemned, allegations that flood plain and wetlands were not developable land by plaintiff.  I prepared expert report, deposition testimony, assisted in deposition of plaintiff’s experts, and court testimony; defendants were awarded a substantial increase in the value for the property by the jury.  Site analysis and appraisals were prepared for comparable sites at FedEx Hubs in Oakland, CA, Boise, ID, Indianapolis, IN, and Fort Worth, TX.

 

Norfolk Southern Railways, Inc. & CSX Transportation, Inc., North Carolina, 1998

The project involved a joint field environmental study of sedimentation impacts due to railways facilities operating throughout North Carolina and presentations to Technical Advisory Committee of NC Sedimentation Pollution Control Commission dealing with rule-making of companies operating within exempt federal railway rights-of-way.

 

Motorola Silicon Chip Manufacturing Plant, Richmond, VA, 1996

The project involved environmental assessment, underground storage tanks assessment and remediation, and environmental permitting for 450-acre site of 5 billion dollar plant site.  Represented NationsBank, the seller, in oversight and control of buyer’s consultants’ investigations and public contacts.

 

Bridgewater Mall, Bridgewater, NJ, 1997

The project involved wetland delineation, wetlands permitting, and hydrologic study for expansion of the regional mall by TrizecHahn Centers, Inc., Chicago, IL.

 

University Place Shopping Center, Charlotte, NC, 1997

The project involved site planning and engineering, wetland delineation, wetland permitting, design of innovative stormwater treatment system for TrizecHahn Centers, Inc., Chicago, IL.

 

Paramus Mall, Paramus, NJ, 1996

The project involved investigation to determine the impact of site soil consolidation and effect on subsurface drainage for existing regional mall that was built over a peat bog; work was for The Rouse Company.

 

Raleigh Town Center Mall, Raleigh, NC, 1995

The project involved rezoning of property, comprehensive plan amendments, transportation plan amendments, wetland delineation, hydrologic study, flood study, and due diligence investigations prior to sale of project.  The work was for TrizecHahn Centers, Inc., Chicago, IL.


Woodbridge Fashion Mall Site, Woodbridge, VA, 1994

The project involved wetland delineation, wetlands permitting, hydrologic study, flood study, Chesapeake Bay Act delineation, and local grading approvals to protect the regional mall site and exempt it from federal environmental and Chesapeake Bay code changes.  The work allowed the Hahn Company, Inc. of San Diego, CA sufficient time to sell the site.

 

General Electric Airfoil Plant, Research Triangle Park, NC, 1994

The project consisted of site assessment, development of stormwater facilities and monitoring program for redevelopment of existing industrial site.

 

Dr. J.D. Robinette v. Alexander County Health Department and North Carolina Department of Environmental Health and Natural Resources, Taylorsville, NC, 1993 

The case was brought before Superior Court, Alexander County, North Carolina; I served as expert witness on behalf of plaintiff re: alleged damages resulting from termination of permits after filing of false documents by State and County regulatory agents.  I conducted investigation, prepared expert report, and presented court testimony.  The Superior Court ordered substantial award to plaintiff, which was overturned by North Carolina Court of Appeals.

 

Carolina Food Processors Plant, Tarheel, NC, 1993

The project involved the environmental permitting for 600-acre site for world’s largest pork processing plant; the permitting of the project involved considerable involvement and resolution negotiations with federal and state agencies.

 

Sandoz Chemical Plant Site, Raleigh, NC, 1992

The project consisted of soil, groundwater, surface water, and environmental assessment of 300-acre industrial development for Sandoz Limited, Inc. (Clariant International, Ltd.) of Basle, Switzerland.

 

Chatham Center Business Park, Savannah, GA, 1991

The project involved soil, groundwater, surface water, and environmental site assessment due diligence investigation of 250-acre commercial and office development for Bank America Real Estate Trust, Charlotte, NC.

 

Virginia Center, Richmond, VA, 1991

The project consisted of environmental water quality planning, flood studies, Chesapeake Bay Preservation delineation, wetlands delineation and wetlands permitting for 1,400-acre business park for Figgie Corporation, Cleveland, OH.

 

Greenfield Business Park, Garner, NC, 1990

The project involved rezoning of property, master planning, environmental planning, wetland delineation, wetland permitting, flood study, and drainage study for 950-acre industrial and business park for Bank America Real Estate Trust, Charlotte, NC.  The work involved increasing the net useable land by 145 acres and saving to the client of over 7.5 million dollars.


Waid Investments, Inc. v. Marshall Oil Company, Raleigh, NC, 1990   

The case was brought before Superior Court, Wake County, North Carolina; I served as expert witness on behalf of plaintiffs re: allegation of petroleum damages to soil and groundwater from leaking underground storage tanks on adjacent property.  I prepared expert reports, proof of causation, exhibits, presented deposition testimony and court testimony; case settled after testimony in court.

 

Huntersville Business Park, Huntersville, NC, 1989

The project involved environmental planning, wetland delineation, wetland permitting, flood study, and drainage study for 430-acre business park for Bank America Real Estate Trust, Charlotte, NC.  Work also involved research of a proposed water supply watershed local ordinance and interlocking trigger of federal categorical exclusions of numerous types of industries.  We worked with the Charlotte Chamber of Commerce and Mecklenburg County Commissioners and recommended an alternative local ordinance which was adopted. 

 

West Creek Business Park, Richmond, VA, 1988

The project consisted of environmental water quality planning, flood studies, Chesapeake Bay Preservation Act delineation, wetlands delineation, wetlands permitting, and investigations/closure of UST’s for 4,000-acre business and industrial park for Bank America Real Estate Trust, Charlotte, NC.  The work involved increasing the net usable land by 974 acres and savings to the client of over 73 million dollars.

Summerwind Plantation, Johnson County, NC, 2007

The project involved multi-disciplinary planning and design of 200-acre retirement mixed-use community.  The work involved rezoning of property, master plan design, ecological studies, wetland delineation and permitting, environmental planning and permitting, stormwater system design including nutrient removal and turbidity controls, stormwater infiltration system design for individual residential and commercial lots, park and open space design, and neighborhood site designs.

 

Wakefield Plantation, Raleigh, NC, 2000

The project involved multi-disciplinary planning, design, and engineering of 1,800-acre mixed-use golf course community. The work involved rezoning of property, master plan approval, transportation planning and design, water and sewer extensions, ecological studies, wetland delineation and permitting, environmental planning and permitting, stormwater system design including nutrient removal and turbidity controls, park and open space design, and neighborhood site designs.  The project was the largest land development project in the City of Raleigh.

 

Preston, Cary, NC, 1991

The project involved multi-disciplinary planning, design, and engineering of 2,200-acre mixed-use golf course community. The work involved rezoning of property, master plan approval, transportation planning and design, water and sewer extensions, ecological studies, wetland delineation and permitting, environmental planning and permitting, stormwater system design, park and open space design, and neighborhood site designs.  The flood study involved revision to FEMA floodplain for West Branch of Crabtree Creek, East Branch of Crabtree Creek, and Coles Branch.  The project was the largest land development project in the Town of Cary.

 

McGinnis Point, Pine Knoll Shores, NC, 1988

The project consisted of multi-disciplinary planning, design, and engineering of ecologically sustainable 75-acre sound fronting retirement community for Theodore Roosevelt Estate.  The work involved ecological studies of maritime forest island system, vegetation management plans, landscape plans, soil and groundwater studies, wetland delineation and permitting, innovative non-discharge stormwater system design, roadway design,  water and sewer design, wastewater treatment plant design, innovative disposal system within maritime forest.

 

Beacons Reach, Pine Knoll Shores, NC, 1986

The project involved multi-disciplinary planning, design, and engineering of ecologically sustainable 750-acre ocean and sound fronting resort residential community for Theodore Roosevelt Estate. The work involved ecological studies of maritime forest barrier island system, salt spray drift studies, vegetation management plans, landscape plans, soil and groundwater studies, wetland delineation and permitting, non-discharge stormwater system design, roadway design, water and sewer design, wastewater treatment plant design, non-discharge wastewater disposal system within maritime forest.
